Terms of Service
These Terms of Service ("Terms") govern your use of dyslexiaevals.com and the online screener, forms, and content we make available through it (together, the "Site"). The Site is operated by Dyslexia Evaluations LLC, a Wisconsin limited liability company ("we," "us," or "the Company"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Evaluation services themselves are governed by the separate service agreements, consent forms, and intake documents you sign before services begin. If those documents conflict with these Terms, those documents control for the services they cover.
1. Who May Use the Site
The Site is intended for parents and legal guardians who are at least 18 years old. By submitting information about a child, you represent that you are that child's parent or legal guardian, or that you have the legal authority to provide the information and request services on the child's behalf.
2. What Our Services Are, and What They Are Not
We provide educational screening and psychoeducational evaluation services. Our free screener is an informational tool that indicates whether a child may be at risk for dyslexia. It is not an evaluation, and its results are not a determination of any condition.
Our comprehensive evaluations provide educational identification of dyslexia and related learning characteristics. Our services are educational in nature. They are not medical services, and they do not constitute a medical or clinical diagnosis. Nothing on the Site is medical, psychological, or legal advice. Content on the Site is for general information only and is not a substitute for advice from a qualified professional who knows your child’s situation.
Whether and how a school provides special education services or accommodations is determined by the school or district under applicable law. We do not control and cannot guarantee any school’s decisions.
3. Screener Results
Screener results depend on the accuracy of the information provided and the conditions under which the screener is completed. A result of "at risk" does not mean a child has dyslexia, and a result that does not indicate risk does not rule it out. Results are intended to help you decide whether further evaluation makes sense for your family.
4. Scheduling, Payment, and Cancellation
- Fees for evaluation services are stated before you book. Payment is processed through our payment processor at the time of booking or as otherwise agreed in writing.
- We are a self-pay practice. We do not bill insurance, and we make no representation that any insurer will reimburse you.
- If you need to reschedule or cancel, contact us as early as possible. Cancellation terms, if any, are stated in your service agreement or booking confirmation.
5. Communications
By providing your contact information through the Site, you agree that we may contact you by email, phone, and text message about your screener results, scheduling, and services, as described in our Privacy Policy. You can opt out of marketing emails at any time, and you can stop text messages by replying STOP.
6. Your Responsibilities
- Provide accurate, current, and complete information in any form you submit.
- Use the Site only for lawful, personal, non-commercial purposes.
- Do not attempt to interfere with the Site's operation, probe its security, scrape its content, or access systems or data you are not authorized to access.
- Do not submit information about a child unless you are authorized to do so.
7. Intellectual Property
The Site and its content, including text, graphics, logos, videos, and the structure of our screening and educational materials, are owned by the Company or its licensors and protected by intellectual property laws. You may view and print Site content for personal use. You may not copy, republish, distribute, or create derivative works from Site content without our written permission. The standardized assessment instruments we administer are owned by their respective publishers.
8. Third-Party Services and Links
The Site uses third-party tools, including form, scheduling, payment, and video conferencing providers, and may link to third-party websites. We are not responsible for the content or practices of third parties. Your use of third-party services is governed by their own terms and policies.
9. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that screener results will meet your expectations.
10. Limitation of Liability
To the fullest extent permitted by law, the Company and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or relating to your use of the Site. To the fullest extent permitted by law, our total liability arising out of or relating to the Site will not exceed the greater of one hundred dollars or the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold the Company harmless from claims, damages, and expenses, including reasonable attorney fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any rights of another person, including submitting information about a child without authority to do so.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to their jurisdiction. Either party may seek relief in small claims court for qualifying disputes.
13. Changes to These Terms
We may update these Terms from time to time. The effective date at the top reflects the most recent version. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
